Employee in Florida day care van death lacked OK to drive

Deborah St. Charles

St. Charles also worked in a classroom at one of the two Orlando daycare centers owned by Little Miracles Academy, and was in one of the classrooms while Myles was left outside in the center's parking lot in the van, the affidavit said.

Charles, 51, was arrested Thursday and charged with aggravated manslaughter of a child by culpable negligence for the death of Myles Hill, the Orlando Police Department said. Orlando police crime scene investigators said the van, at noon, would have reached between 115 and 144 degrees.

"Please ensure that we are checking our vehicles for our kids", Mina said, pleading with parents and caregivers.

Authorities have closed down two Little Miracles Academy locations. St. Charles assumed that everyone had gotten off but "admitted to failing to perform a head count to be sure", the affidavit notes.

On Friday, a judge set St. Charles's bail at $30,000 and ruled that if released on bond, she could not work for a child-care center or have unsupervised contact with children, according to CBS affiliate WKMG.

St. Charles returned to the van and drove it to Little Miracles Academy I on Plymouth Avenue. Once there, St. Charles then exited the van, walked around and opened the van's rear hatch to remove cleaning supplies she was instructed to deliver, she told police.

"I want to apologize to Myles", Audrey Thornton, the owner of Little Miracles Academy, said through tears.

Charges are pending against the driver, who told the police she did not do a head count when dropping off the children, Mina said. When St. Charles parked the van she received a phone call, and was on the phone when she grabbed her personal belongings and locked the van without looking around, the report shows.

The van is used by the day care centre to pick children up and drop them off at their homes.

The high temperature was reportedly about 34 degrees Celsius in Orlando on Monday. The Orange County medical examiner's office listed Myles' cause of death as hyperthermia due to environmental exposure. We are conducting a thorough investigation and are assisting law enforcement with their criminal investigation.

According to Frady, Little Miracles had been cited in the past for not keeping proper paperwork. "We will continue to aggressively act to keep kids safe and will hold anyone accountable who doesn't follow the law".

Myles was supposed to have been dropped off in the morning at another Little Miracles Academy day care center but instead the boy was taken to the location where he was found on the floor of the vehicle more than 11 hours later.
