The Congress said that there was a clear connection between the raids and the upcoming elections in Gujarat for three Rajya Sabha seats, while the I-T department said this was a pre-planned raid.

Despite the NOTA being available during the polls, Congress said that it would issue a whip to all its MLAs to vote for Patel.

As per government officials, the directions to use NOTA in Rajya Sabha elections were enforced in January 2014 after the Supreme Court in 2013 made it mandatory to have NOTA option in EVMs. The Supreme Court judgment formalising NOTA repealed a provision in the Conduct of Election Rules (Section 49-O) which allowed a voter to visit a polling booth and inform the presiding officer that he/she had decided not to vote, which was to be recorded accordingly.

The letter further adds that "there is no secrecy" for voting in Rajya Sabha elections, therefore "the goal of NOTA is of not much use in such election". The Rajya Sabha witnessed protests by the opposition against the "witch-hunt by the government".

However, the I-T department stated that the raids were conducted against one individual and the presence of the Gujarat MLAs was unforeseen.

In the Gujarat Rajya Sabha polls, MLA's have to show their ballot paper to the party agent before putting it in the ballot box.

Subsequently, the rattled Congress tucked away 44 of its MLAs to a Bengaluru resort to insulate them from alleged "poaching" attempts by the BJP.

Adding that the decision to fly to Bengaluru was taken collectively by the legislators, the party said its leaders were being regularly threatened by the BJP.

Earlier in the day, BJP state president Jitu Vaghani said that the grand old party has failed itself.

Parmar has challenged the Election Commission's notifications and the Assembly's circular dated August 1, which make the "None Of The Above" (NOTA) option applicable to this year's Rajya Sabha elections, which are to be held on August 8. The Congress has moved its remaining 44 MLAs to a luxury resort in Karnataka in the hope of preventing further defections.
