Soldier guns down state trooper and soldier's wife, police say

Trooper Joel Davis, a married father of three, was responding to a 911 call reporting an argument Sunday night in Theresa, N.Y. Davis, 36, reached the home about 80 miles north of Syracuse about 8:30 p.m.

New York State Trooper Joel Davis was doing one of the most unsafe jobs a police officer can face responding to a domestic dispute.

Walters' wife, 27-year old Nichole V. Walters, was also found deceased at the scene. Another woman who lived on the property was also shot, but she didn't suffer life-threatening wounds.

Davis's brother, Josh Davis, is a Watertown police officer, stated WNYF-TV.

Justin Walters, the man accused of killing his wife and a NY state trooper Sunday, served in the Army and was stationed at Fort Drum, N.Y., for about the past decade.

In a statement early Monday morning, New York Gov. Andrew Cuomo said "the entire New York family grieves" for Davis.

But his arraignment had to be delayed after Walters failed to answer the judge's questions.

The New York State police confirmed that Walters was a USA soldier on active duty. "We believe that the round entered the side of that and fatally injured the trooper", Beach said. He waived his preliminary hearing, which meant the case will go straight to a grand jury.

Walters, 32, surrendered to authorities in his driveway. He also told the court he thought his rifle was unloaded and thus he fired at his wife, according to the News Tribune.

According to the U.S. Army, Walters comes originally from the town of Zeeland, MI.

A study by the Rand Corp. estimated that 18.5 percent of veterans who served in Iraq and Afghanistan show signs of post-traumatic stress or major depression.

Flags on all state buildings will be flown at half-staff starting Wednesday to honor the state trooper killed Sunday night in Jefferson County.
