Do we want a democracy in which politicians (of any party) can virtually assure their re-election and continued dominance in a state simply because of the way that they draw the maps?

The justices in a brief written order said they would review a redistricting case from Wisconsin, where a three-judge lower court past year invalidated a redistricting plan enacted by the Republican-controlled Wisconsin legislature in 2011. The state's lawyers said the districts were compact and neatly drawn.

The issue will be briefed and argued in the Supreme Court term that begins in October. The Supreme Court has never struck down districts because of partisan advantage.

The case involves district lines in Wisconsin that challengers say were drawn unconstitutionally to benefit Republicans. And the reverse applies in Democrat states, although they are fewer in number.

"Technology has made it easier than ever for self-interested legislators to manipulate districts for political advantage, so it is essential that courts step in to protect voters' fundamental constitutional rights". In 2012, Republicans received about 49 percent of the vote but won 60 of the 99 state Assembly seats.

The potential landmark case could decide how far state legislatures can go in drawing up district lines for partisan gain.

The justices last took up the topic in 2004 in a case called Vieth v. Jubelirer .

He continued: "If the justices agree, it would be the first time the court has articulated a constitutional rule in this context, which could - and likely would - have enormous ramifications nationwide".

Opponents of partisan gerrymandering celebrated the court's decision to consider the issue again.

Justice Anthony M. Kennedy was in the middle. The Court's decision in this case will determine whether that ideal becomes a reality.

In an attempt to show why the Wisconsin maps were unconstitutional, the plaintiffs relied on the "efficiency gap" to make their case. Republicans in OH and Pennsylvania have done the reverse, concentrating urban voters in a few heavily Democratic districts.

Under the approach, developed by two University of Chicago professors, every voter packed into a district above the threshold needed to elect a candidate from his party creates a "surplus" vote. Surplus and lost votes are considered wasted votes. "Any vote cast for a losing candidate is considered wasted, as are all the votes cast for a winning candidate in excess of the number needed to win".

The Wisconsin court was not so definitive.

"Wisconsin's gerrymander was one of the most aggressive of the decade, locking in a large and implausibly stable majority for Republicans in what is otherwise a battleground state", said Brennan Center redistricting expert Thomas Wolf.

The state argues recent election results favoring Republicans were "a reflection of Wisconsin's natural political geography", with Democrats concentrated in urban areas like Milwaukee and Madison.

In March, a panel of judges ruled that three of the state's 36 congressional districts were illegally drawn.

Several Democratic voters joined a lawsuit contending this partisan electoral map violated their rights to an equal vote.
