Attorney: Officer threatened black man before fatal shooting

"Although the videos do not show Sterling's right hand at the time those shots were fired, they show that Sterling's right hand was not under Officer Salamoni's control", the report said.

Two white Louisiana police officers will not face federal charges for the fatal shooting of a black man that sparked nationwide protests a year ago, USA officials said on Wednesday, though the state is opening its own criminal investigation.

The department's scheduled news conference comes after twin reports Tuesday from the Washington Post and The New York Times that said DOJ had closed its probe into Sterling's death and that charges will not be brought against the Baton Rouge officers involved in the shooting.

As of nightfall on Wednesday, the streets of Baton Rouge were quiet, with a few protesters gathering under intermittent rain. "Sterling was not going for a gun, or more accurately that the officers did not believe he was reaching for a gun and therefore we can't establish that the lethal force that was used was unreasonable". He went on to explain that there was not enough evidence to prove that Salamoni and Howie Lake II acted unreasonably and willfully.

Amundson did not mention the alleged threat and did not take questions.

A loaded 38 caliber revolver was removed from Sterling's pocket.

During a 10-month investigation, FBI agents and prosecutors reviewed images of the incident captured by body cameras, cellphones and store surveillance cameras as well as witness accounts and other evidence, the Justice Department said. Landry said a prosecutor from the Louisiana Department of Justice will assist state police.

Although the investigation is over on a federal level it is being turned over to Louisiana State Police. "As such, we ask for patience from the public and the press", Landry said. When they arrived on the scene, they discovered Sterling, and pinned him to the ground; someone shouted "gun" before the officers fired.

"While we await that decision", Edwards said, "and as I've said many times. we still have too many people in our community who are afraid of the police and too many police officers afraid of members of our community".

John McLindon, Salamoni's lawyer, said he could not comment on the allegations. The state had held off on its investigation pending the conclusion of the federal investigation.

The press release outlines the findings in Sterling's case.

The shooting sparked nationwide protests amid a fierce debate over police treatment of minorities. They looked for evidence of the location of Sterling's right hand as he struggled with the officers who tried to subdue him.

Therefore, this matter now needs to be investigated for possible state criminal violations. "Also, no one in my office or the governor's office has been notified by the U.S. Attorney's office of a decision or timeline", Mayor Sharon Weston Broome said in a statement.

Sterling's aunt Sandra Sterling called the Justice Department's reported decision "crazy".

"I do hope there will be some investigation to find out" how that information was leaked, Edwards said.

Sterling's family held a simultaneous news conference to call on Louisiana Attorney General Jeff Landry to pursue state criminal charges.

In some cases, but not this one, the federal Civil Rights Division conducts a civil investigation into whether a police department has engaged in "patterns and practices" in violation of civil rights laws.
