Perhaps the biggest hit is that the lawsuit claims Bose sends the data to a third party.

MA headphone and speaker giant Bose is facing its second high-profile lawsuit in as many months, with a new case claiming the company's app secretly records audio its customers listen to and sends the data to third-party companies.

"People should be uncomfortable with it", Christopher Dore, a lawyer representing Zak, said in an interview.

Bose, the renowned audio maker, is accused of spying on its customers by harvesting their personal information and giving it to third parties without proper consent of the users. The app in process sought his info like name and e-mail address, a standard procedure for registering on apps. He later learned that "all available media information" had been sent from his smartphone to third parties, including a company known as "Segment.io", which seems to proudly come up with ways for companies to farm customer data and spread it around.

The complaint argues that the music, radio programs, and podcasts people listen to "reveal sensitive information about themselves that suggests their politics, religious views, thoughts, sentiments, and emotions".

A lawsuit filed on Tuesday alleges that Bose Corp.is spying on consumers by tracking the music audio they listen to and selling that information without permission.

Zak also alleges in the lawsuit that the data collection violates the federal Wiretap Act as well as IL state laws against eavesdropping and consumer fraud.

The complaint says that Bose created detailed profiles of customers using the app, including their listening histories and habits - what was played multiple times, which songs were skipped, etc - and then shared these profiles with marketing companies.

"Defendant's conduct demonstrates a wholesale disregard for consumer privacy rights and violates numerous state and federal laws", the complaint alleges.

If the case is won, Bose could be stung with millions of dollars in damages, payable to anyone who's bought this specific range of headsets.

Bose has yet to respond to requests for comment.
