Delay in consular access to Jadhav irks India

HC Reserves Order on Plea to Direct Govt to Secure Jadhav's Release

Giving details, petitioner Gaurav Bansal said the Central government should immediately proceed towards global court to secure Jadhav's release.

Expressing disappointment over Pakistan repeatedly turning down India's request for consular access to Mr Jadhav, the Indian envoy had also said, "They have denied our request for consular access 13 times (in the last one year)".

"I have forcefully asked for consular access on the basis of the global law and on humanitarian grounds as he is an Indian national".

The bench said: "Every possible endeavour is being made by the government of India to secure the life of the citizen (Jadhav). the matter best deserves to be left to the expertise of the government".

It said that any revelation regarding the efforts being made by the government may prejudice their success or frustrate the steps in this regard.

"The government and people of India would view very seriously the possibility that an innocent Indian citizen is facing death sentence in Pakistan without due process and in violation of basic norms, law, justice and global relations", she said.

Indian High Commissioner Gautam Bambawale is likely to meet Pakistan's Foreign Secretary Tehmina Janjua to discuss the issue of Kulbhushan Jadhav, who has recently sentenced to death by a Pakistani military court.

Pakistan army spokesman major general Asif Ghafoor has already rejected any chance of granting consular access to Jadhav who was sentenced to death for espionage and subversive activities.

The Pakistan Army had earlier said there will be "no compromise" on the issue of death sentence awarded to Jadhav. India has denounced Jadhav's trial as a farce, insisting he was abducted from Iran and that his subsequent presence in Pakistan was never credibly explained.

Sources in the Foreign Office in Islamabad said that the issue of Jadhav is expected to be the focus of the meeting as India has been seeking consular access to its convicted citizen.

He told media after his previous meeting on April 14 that he had asked for list of charges and authentic copy of verdict of military tribunal against Jadhav to launch appeal against his conviction.

"We will pass our order today", the bench said.
